3. Quotes and Estimates

Before any work is performed, Premier Painting & Contracting LLC will provide a written estimate or quote for the services requested. The quoted price is based on the information provided at the time of the estimate and may be subject to change if the scope of work changes.

4. Payment Terms

5. Client Responsibilities

The client is responsible for ensuring that the work area is ready for the painting or staining services. This includes, but is not limited to:

• Ensuring that all furniture, valuables, and obstacles are moved out of the work area.
• Ensuring that pets and children are kept away from the work area for safety reasons.
• Providing access to the property and necessary utilities (water, electricity) as needed for the completion of the project.

If the client fails to meet these responsibilities, Premier Painting & Contracting LLC may charge additional fees or delay the project until the necessary preparations are made.

6. Warranty and Guarantees

Premier Painting & Contracting LLC offers a warranty for its painting and staining services. The warranty covers defects in workmanship, but not damage caused by external factors such as weather, accidents, or improper maintenance.

• Exterior Painting and Staining: The warranty covers a period of one year from the date of completion for defects in workmanship. Any issues related to improper application or material defects will be addressed at no additional cost to the client during the warranty period.
• Interior Painting: For residential and commercial interior painting projects, Premier Painting & Contracting LLC offers a six-month warranty on workmanship. This warranty does not cover damage from wear and tear, cleaning, or misuse.

Any claims made under the warranty must be reported within the warranty period, and Premier Painting & Contracting LLC reserves the right to inspect and assess the issue before proceeding with any remedial work.

7. Liability and Insurance

Premier Painting & Contracting LLC carries comprehensive liability insurance to cover any potential damages that may occur during the course of a project. While we take every precaution to avoid accidents, the company is not liable for any damages to the client’s property unless caused directly by the actions of our team.

By agreeing to these Terms and Conditions, the client acknowledges that Premier Painting & Contracting LLC is not responsible for pre-existing conditions that may affect the outcome of the project, such as:

• Cracks, holes, or damage to walls or surfaces.
• Previous paint or stains that have failed to adhere properly.
• Any other issues caused by prior work done on the property.

8. Termination and Cancellations

Either party may terminate the agreement before the start of the project by providing written notice to the other party. If the client cancels the project after the work has begun, they are responsible for paying for any work completed up to the point of cancellation, including materials, labor, and other associated costs.

In cases where Premier Painting & Contracting LLC must cancel a project due to unforeseen circumstances (e.g., weather, equipment failure), we will make reasonable efforts to reschedule the work at a mutually agreeable time.

9. Dispute Resolution

Any disputes arising out of or in connection with the services provided by Premier Painting & Contracting LLC should be resolved through good faith negotiations. If a dispute cannot be resolved amicably, the parties agree to submit the dispute to mediation or arbitration before resorting to legal action.

10. Governing Law

These Terms and Conditions are governed by the laws of the state of Oregon. Any legal actions or proceedings arising out of or relating to these Terms and Conditions shall be conducted in the appropriate courts located in Gresham, Oregon.
